TERMS OF SALE, NON-NEGOTIABLE:
A) No Returns or Exchanges on Metal Roofing or Siding Panels, Special Order/Made Products, Standing Seam Trims, or any other item marked non-returnable on the order. All order cancellations or order changes will be subject to verifying orders have not been made, if it’s a standing seam/special order, that the coils/products have not been ordered. If any of the above conditions are met, your order will be non-cancelable/changeable.
B) All payments made by credit card will be charged the day the order is placed. Orders placed using Net30 Terms are billed upon production commencement.
C) If returning an item, the item must be in new, unused, and unopened condition, dry and clean, returned within 30 days of receiving, and you must provide the original receipt. There is a 25% restock charge for ALL returned/exchanged metal trim items, including skylight panels. We reserve the right to refuse any item being returned/exchanged for any reason.
D) All item prices are FOB at the supplier or manufacturer location. Freight charges will be paid by the purchaser for special order products to be shipped to MMMS.
E) All dimensions of products are nominal including coverage. All trims have a +/-1/8″ tolerance and all angle degrees are nominal. All panels have a -1/4″ tolerance and +2″ tolerance.
F) Standing Seam Panels are made standard with Striations. Oil canning and telegraphing are common for steel panels and is not a probable cause for return or rejection.
G) MMMS does not guarantee the list of products on a proposal or sales order to complete a project and should be considered an estimated list only. We agree only to provide what is listed on the sales order.
H) Fourteen days after the pickup date on a sales order, storage charges will be assessed at $50/day. Orders left on our premises for more than 60 days past the pickup date will be considered abandoned, and such orders will be disposed of with no refund.
I) Except as set forth on MMMS’s website captioned, “Product Warranties” at midmichiganmetalsales.com which is subject to change at MMMS’s sole discretion, customer acknowledges that there are no representations or warranties, express, implied, or otherwise, of any kind or nature. All claims for consequential, incidental, or punitive damages are hereby waived by the customer. MMMS specifically disclaims any warranties for merchantability or fitness for a particular purpose. All manufacturer’s warranties are issued per the manufacturer to customer through their warranty process.
J) In recognition of the relative risks, rewards, and benefits of the project to both customer and MMMS, the risks have been allocated such that the customer agrees that, to the fullest extent permitted by law, MMMS’s liability to customer for any and all injuries, claims, losses, expenses, damages, or claim expenses arising out of this agreement from any cause or causes shall not exceed the value of the compensation received pursuant to this agreement.
K) OUR COLORS AND TRIM PIECE CHOICES DO NOT MATCH COMPETITORS’ COLORS. They are MMMS Colors and Trims.
L) OUR PAINT FINISHES ARE BATCH-SPECIFIC AND MAY RESULT IN SLIGHT VARIATIONS IN VISUAL MATCH. YOU AGREE YOU WILL NOT MIX OR USE PANELS PURCHASED FROM SEPARATE SALES ORDERS ON THE SAME PROJECT.
M) ALL DELIVERY or PICKUP DATES ARE ESTIMATES AND ARE NOT BINDING or GUARANTEED.
N) All claims for damage on products received must be made within 48 hours of receiving your product. Damage must be documented accordingly.
